Terms of Service
These Terms form a binding agreement between Gasher Solutions LLC (“we,” “us,” “our”) and you (the “Customer”). By creating an account, signing a proposal, or using Gasher at https://www.gasher.ai, you agree to these Terms. If you’re entering into this Agreement on behalf of a company, you represent that you have authority to bind that company. Business use only (B2B).
1) What we provide
We offer an all-in-one marketing and customer engagement platform purpose-built for pool service businesses, including: (a) website creation/hosting/support, (b) CRM & messaging (web + mobile), (c) forms/surveys & pipeline, (d) calendar booking, (e) email/SMS marketing, (f) AI chat (EN/ES), and (g) automations. “Voice AI readiness” and advanced two-way AI conversations are available on Premium. We may enhance or modify features from time to time.
- White-label & mobile: Your account runs on our white-labeled platform with access via the LeadConnector mobile app.
- Support access: You allow limited access to conversation logs (SMS, email, chat, DMs, and, if enabled, Voice AI transcripts) solely for troubleshooting, optimization, and quality assurance.
- Usage-based add-ons: Telephony/SMS/AI usage and similar consumption-based items are billed separately and may include a markup.
3) Plans, billing, and trials
- Plans: Essential $297/mo (subject to change), Premium $497/mo. Setup fees currently waived as a promotional offer; we may reintroduce setup fees at any time.
- Free trial: 14-day free trial. Credit card required to start. Trial start date is set by Gasher at our discretion so we can finish initial setup (CRM, mobile app access, calendar, AI chat, and a initial website draft where applicable). The paid plan begins exactly 14 days (336 hours) after the trial start time unless canceled in writing before the end of the trial.
- Billing: Billed monthly in advance once your account is live. Payments are due immediately and are non-refundable except where required by law.
- Refunds: No refunds on the first three months of paid service. We may issue credits/refunds case-by-case for billing errors (e.g., duplicate charges).
- Usage fees: Any consumption-based charges (e.g., AI tokens, SMS segments, call minutes/recordings, telephony, third-party API calls) are billed separately and may include a markup.
- Upgrades/Downgrades: Change plans anytime; mid-cycle changes are prorated.
- Taxes: Prices exclude taxes; you are responsible for any applicable taxes.
- Late/failed payments: Late amounts accrue a finance charge of 1.5% per month (18% APR) or the maximum permitted by law, whichever is less, after a 14-day grace period, and we may suspend the account until paid. Accounts more than 30 days past due may be terminated.
4) Cancellations & terminations
- Cancel: Email [email protected] with 14 days’ notice. Service ends at the later of (a) the end of your current billing cycle or (b) 14 days from notice.
- After cancellation: On request we’ll export your CRM data (CSV/JSON) and remove hosted site(s) at end of service.
- Non-payment: Accounts may be suspended after missed payment; access resumes upon full payment. We aren’t responsible for any impact from suspension due to non-payment.
- Deletion window: If you don’t request an export within 30 days after termination or suspension, your data may be permanently deleted and unrecoverable.
- For cause: We may suspend/terminate immediately for legal violations, abuse, or non-payment.
5) Data ownership & websites, content, and IP
- You own your customer data. We claim no ownership over your contacts, messages, call logs, or uploaded content.
- You grant us a limited license to host, process, transmit, and analyze your data to provide and improve the Service.
- Support access is role-limited and logged.
- Your content: You warrant rights to the content you upload (text, images, audio/video, logos).
- Our materials: Platform software, templates, widgets, animations are our or our licensors’ IP. License: non-exclusive, non-transferable, usable only while subscribed. No resale/redistribution without written permission.
- Attribution: “Powered by” branding may be removed per plan or agreement.
7) Compliance & acceptable use
Don’t: (a) violate laws or IP; (b) send unsolicited messages without consent; (c) probe/disrupt; (d) upload malware; (e) use for high-risk/safety-critical purposes. You’re responsible for opt-in records and opt-out compliance (e.g., STOP/HELP for SMS).
Messaging responsibility: You control your campaigns/templates. Gasher does not pre-approve messages and has no duty to monitor. You’re solely responsible for TCPA/CTIA/carrier compliance. We may throttle/suspend/terminate messaging that risks carrier blocks, high bounces/complaints, or legal violations.
Email authentication: Before bulk sending, configure SPF/DKIM (and DMARC where applicable). We may throttle/suspend until authentication and reputation are satisfactory.
Restricted industries: We do not support cannabis, firearms, payday lending, illegal substances, adult/explicit content, or other high-risk/regulated categories we identify.
8) Service levels & support
- Uptime: High availability target; no guarantee of uninterrupted service. Planned maintenance/third-party outages may occur.
- Support hours: Mon–Fri, 10:00 AM–5:00 PM ET via [email protected]. After-hours: case-by-case.
- Changes: We may update features/limits; material changes via email when practicable. Existing prices locked for at least 90 days.
9) Third-party services
Some features use third parties (e.g., LeadConnector Email for native email, LC Phone for telephony/SMS, hosting, analytics, payments, AI models). Their terms/fees apply. We’re not responsible for their acts/omissions.
10) Confidentiality
We protect your non-public data with reasonable safeguards and use it only to provide the Service, except where disclosure is required by law.
11) Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT). AI OUTPUTS MAY BE INACCURATE OR UNSUITABLE.
12) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA. EXCEPT FOR YOUR PAYMENT AND INDEMNITY OBLIGATIONS, EACH PARTY’S TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS PAID OR PAYABLE BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT. MULTIPLE CLAIMS DO NOT ENLARGE THE LIMIT. NOTHING LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.
13) Indemnification
You will defend and indemnify us against claims arising from your content, unlawful messaging, or misuse of the Service, including regulatory complaints about consent/telemarketing laws.
14) Export controls & sanctions
You are not in a prohibited jurisdiction and will not use the Service in violation of export/sanctions laws.
15) Governing law; disputes
Florida law governs. Venue/jurisdiction: courts in Seminole County, Florida. No mandatory arbitration. Jury trial waived to the extent permitted by law.
16) Publicity
We may reference your company name/logo for customer lists and case studies unless you opt out by emailing us.
17) Changes to Terms
We may modify these Terms. If changes are material, we will notify you (e.g., email/in-app). Continued use after changes means acceptance.

Program: Gasher notifications and updates. Message frequency: Varies by account activity.
Opt-in: By providing your mobile number on our forms or in your account and submitting, you consent to receive SMS from Gasher.
Opt-out: Reply STOP to cancel at any time.
Help: Reply HELP for help or email [email protected].
Rates: Message and data rates may apply. Carrier liability: Carriers are not liable for delayed or undelivered messages.
Privacy: We do not sell or share mobile numbers for marketing/promotions. Mobile information may be shared with subcontractors solely to provide support services. See our Privacy Policy.
